Welcome to Shwink. By creating an account or using the app you agree to these Terms. If you don't agree, don't use the app.
1. Who Can Use Shwink
At least 13 years old. Under 18 requires a parent/guardian's agreement.
2. Your Account
You're responsible for your account; keep your password secure; use accurate info; one account per person; no impersonation.
3. Your Content
You own your photos, Shwink Cards, and captions. By posting you grant Shwink a non-exclusive, royalty-free licence to store/display/distribute that content to other users as part of operating the app; the licence ends when you delete the content or your account. Don't post content that infringes IP, is abusive/threatening/harassing, contains nudity or graphic violence, spreads false info, violates privacy, or promotes illegal activity / self-harm / hate. Every photo is auto-scanned before publishing; reported violations may be removed; repeated violations lead to suspension or termination.
4. Acceptable Use
No spam/bots/automation, scraping, hacking/reverse-engineering, unsolicited messages, fake engagement, or impersonation.
5. Health Data & Safety
HealthKit/Google Fit data is used only for shoot stats. Not medical advice; Shwink is not a health/medical service. You work at your own risk; Shwink has no liability for injury or health events during your work.
6. Intellectual Property
The Shwink name, logo, brand, and app are owned by Sensego (Pty) Ltd. No copying, redistributing, or building competing products with our brand/code without written permission.
7. Reporting & Enforcement
Report rule-breaking content/users in-app; we aim to act within 24 hours (warn, remove, suspend, or terminate, and may block re-registration). You can also block users (they aren't notified).
8. Termination
You can delete your account anytime from Profile settings (removes your data immediately). We may suspend/terminate for violations or legal reasons, with notice where possible.
9. Disclaimer of Warranties
Provided "as is" / "as available"; no guarantee of error-free or uninterrupted service.
10. Limitation of Liability
No liability for indirect/incidental/consequential damages. Total liability capped at the greater of what you paid us in the prior 12 months or US$50.
11. Changes to These Terms
We may update these Terms and will notify you in-app of significant changes.
12. Governing Law
Governed by the laws of South Africa; disputes handled in South African courts; EU residents retain local consumer-protection rights.
